Terms of service

Draft. Early-access accounts are covered by the early-access agreement sent with the sign-in link. These terms take effect at general availability and may change until then.

1. The service

Macswarm provides hosted macOS environments (“Pods”) on Apple hardware that Macswarm owns and operates, for continuous integration and developer services: building, testing and running software with coding agents. Pods are created per session from a standard image and destroyed when the session ends. Macswarm does not provide access to language models; you bring your own Anthropic or OpenAI account.

2. Your account

You must be 18 or older and use the service for your own or your organization’s software development. Keep environment keys and webhooks confidential; you are responsible for sessions started with them. Tell us at once if a key is exposed and we rotate it.

3. Acceptable use

Use Pods to build, test and run software you are allowed to work on. Do not use them to mine cryptocurrency, attack other systems, circumvent Apple’s or anyone’s licenses, run services for third parties, or store content unrelated to development. No inbound network access or interactive remote sessions are provided and none may be created.

4. Your content

Code, secrets and data you bring into a Pod remain yours. We process them only to run your sessions, as described in the privacy policy. We keep no copy after the Pod is destroyed, apart from the logs and screenshots agents produce, which you can delete.

5. Plans and billing

Plans and rates are listed on the pricing page. Usage is metered per second while a Pod runs. Monthly plans renew until cancelled and are billed in advance; extra Pod-hours are billed in arrears. Payments are processed by Paddle, our merchant of record. Enterprise plans are invoiced under their contract. Refund terms are in Refunds.

6. Availability

We aim for Pods to be available whenever your plan allows one and the region’s pool has capacity, and we tell account owners about planned maintenance in advance. Early access carries no uptime commitment. Enterprise plans can include a service-level agreement.

7. Changes and termination

You can cancel at any time from the dashboard; the plan runs to the end of the paid period. We can suspend an account that breaks section 3, after notice unless the breach endangers other customers. We may change these terms with 30 days’ notice by email.

8. Liability

The service is provided as described. To the extent the law allows, Macswarm’s liability for any claim is limited to the fees you paid in the 12 months before the claim, and neither party is liable for indirect or consequential loss. Nothing limits liability that cannot be limited by law.

9. Governing law

These terms are governed by the law of the Netherlands. Disputes go to the competent court in Amsterdam, unless you are a consumer with the right to your home court.
